1. HOW TO ENTER: NO PURCHASE NECESSARY. Feria
LA Fashion Week Getaway ("Giveaway") begins
Company assumes no responsibility for
lost, late or misdirected entries, illegible or mutilated entries
or for any computer, online, telephone, cable, network, electronic or
Internet hardware or software malfunctions, failures, connections,
availability, garbled or jumbled transmissions, service provider, Internet,
website, or other accessibility or availability malfunctions that may occur.
Entrants shall be the authorized account holder of the email address submitted
at the time of entry. "Authorized account holder" is defined as
the natural person who is assigned to an email address by an Internet access
provider, online service provider, or other organization (e.g., business,
educational institution, etc.) that is responsible for assigning email
addresses for the domain name associated with the submitted email
address. If, for any reason, the Giveaway is not capable of completion as
planned, including by reason of infection by computer virus, bugs,
tampering, unauthorized intervention, fraud, technical failures or any other
causes beyond the control of Company which corrupt or affect the
administration, security, fairness, integrity or proper conduct of this
Giveaway, Company reserves the right at their sole discretion to cancel,
terminate, modify or suspend the Giveaway.
2. ELIGIBILITY: This
Giveaway is only open to legal US residents, excluding Puerto Rico, who, as of
the date the Giveaway begins are 18 years of age or older.
Employees of Company, L’Oréal USA, Inc. or their affiliates, parent companies,
subsidiaries, prize suppliers, advertising or promotional agencies of Company, L’Oréal
USA Inc. and their immediate families (spouse, parents, children, siblings and
their spouses) and individuals living in same household as such employees
are not eligible. This Giveaway is governed by the laws of the
3. JUDGING: Winners will be selected by random drawing by a
Company representative on or about
4. PRIZES: There will be 1 winner selected.
The winner will receive: (a) two (2) round trip economy
class air tickets departing from major airport nearest winner’s city of
residence to Los Angeles, California on October 13, 2005 and two night double
occupancy hotel room at a three star hotel in greater Los Angeles, California,
including ground transportation to and from airport, hotel and event location; and
(b) two (2) tickets for the Fashion Week “GenArt Great Faces in Fashion” Event
on Friday October 14, 2005 at the Barker Hangar in Santa Monica, California (approximate
retail value $3,500). The prize cannot be exchanged for cash, and cannot
be used in conjunction with any other promotion. Company reserves the
right to substitute a prize of equal or greater value in the event the offered
prize is unavailable and to substitute air transportation with comparable
ground transportation for anyone residing in the greater metropolitan
5. GENERAL CONDITIONS: All
federal, state, and local taxes, fees and surcharges on prize packages are the sole responsibility of the prize
winner. Winner grants Company the right to use and publish their
legal name and state of residence online and in print, or any other media, in
connection with the Giveaway. Except winners who are residents of the State of
Tennessee, acceptance of a prize constitutes permission for Company and their
advertising and promotional agencies to use winners' names and likenesses for
editorials, advertising and promotional purposes without payment of additional
compensation unless prohibited by law. By entering, participants release and
hold harmless Company, L’Oréal USA, Inc. and their respective parent companies,
subsidiaries, affiliates, directors, officers, employees, attorneys, agents and
representatives from any and all liability for any injuries, loss, claim,
action, demand or damage of any kind arising from or in connection with the
Giveaway or any prize won, any acceptance, use, misuse or malfunction of any
prize awarded, participation in any Giveaway related activity, or participation
in the Giveaway. Except where
prohibited, all issues and questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights and obligations of
the entrant and the Sponsor(s) in connection with the Giveaway, shall be
governed by, and construed in accordance with, the laws of the State of New
York without giving effect to any choice of law or conflict of law rules
(whether of the State of New York, or any other jurisdiction), which would
cause the application of the laws of any jurisdiction other than the State of
New York. In addition, any dispute
relating to the Giveaway (including these Official Rules) shall be brought in
the appropriate state or federal court having jurisdiction over the subject
matter located in the City and
CAUTION: ANY ATTEMPT BY A
CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR
UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL
AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT
TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY
LAW.
